Terms of Service
These Terms of Service ("Terms") govern your use of FightMyTicket, a service operated by Daniel Carabano d/b/a FightMyTicket ("FightMyTicket," "we," "us," "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. What FightMyTicket is — and is not.
FightMyTicket is an informational tool. You upload a photo of a New York City ticket or summons; our software, using artificial intelligence, produces an analysis and draft response documents to help you prepare and submit your own defense. FightMyTicket is not a law firm, is not a lawyer, and does not provide legal advice or legal representation. Using the service does not create an attorney–client relationship. The analysis and documents are information and opinion only. You are representing yourself, and you are solely responsible for what you submit to any government agency. [ATTORNEY] — confirm this framing satisfies New York’s unauthorized-practice-of-law rules.
2. No guarantee of outcome.
We do not guarantee that any ticket will be dismissed or reduced, or any particular result at any hearing. Outcomes depend on facts, evidence, and decision-makers outside our control.
3. Eligibility.
You must be at least 18 years old and able to form a binding contract to use the service.
4. Accounts.
You may create an account using a one-time email link. You are responsible for activity under your account and for the accuracy of the information you provide.
5. Credits, payments, and fees.
- A new account receives 100 free credits, enough for one analysis. New accounts also receive a one-time waiver of the translation surcharge on their first analysis.
- One analysis costs 100 credits, and each follow-up question costs 8 credits. Credits may be purchased in packs (currently $2.99 per 100 credits). Follow-up questions are paid from your credit balance and are not sold separately.
- Payments are processed by Stripe; we do not store your card details.
- Analyses are delivered instantly and are non-refundable once generated. This is not a money-back service.
- Prices may change; changes apply to future purchases.
6. Your responsibilities.
You agree that: every statement you submit through the service or to any agency is truthful; you will review every analysis and document before submitting anything; you are responsible for meeting all deadlines on your ticket; and you will not rely on the service as a substitute for advice from a licensed attorney, particularly for high-stakes or complex matters.
7. Acceptable use.
You may not use the service to upload tickets you are not authorized to contest, to submit false information, to misuse or copy the service, or for any unlawful purpose.
8. Intellectual property.
The service, its software, and its content are owned by Daniel Carabano d/b/a FightMyTicket. The analysis and documents generated for your case are provided for your personal use in contesting your own ticket.
9. Disclaimer of warranties.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty that the analysis is accurate, complete, or fit for a particular purpose. Artificial intelligence can make mistakes; you must verify all facts, codes, fines, and deadlines yourself.
10. Limitation of liability. [ATTORNEY]
To the fullest extent permitted by law, Daniel Carabano d/b/a FightMyTicket will not be liable for any indirect, incidental, consequential, or special damages, or for any fine, penalty, or adverse outcome of any ticket or hearing. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim.
11. Indemnification. [ATTORNEY]
You agree to indemnify and hold harmless Daniel Carabano d/b/a FightMyTicket from claims arising out of your use of the service, your submissions to any agency, or your breach of these Terms.
12. Use of case data.
We use case data and outcomes to operate and improve the service, including improving our defense database, as described in the Privacy Policy.
13. Changes; termination.
We may modify these Terms or the service; continued use means acceptance. We may suspend or terminate accounts that violate these Terms.
14. Governing law and disputes. [ATTORNEY]
These Terms are governed by the laws of the State of New York. The dispute-resolution mechanism (court venue or arbitration with class-action waiver) is pending attorney review and will be inserted prior to finalization.
